Accept responsibility for all activity conducted through your account

You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations.

4. AI & Automated Communications Consent

By using Hojo AI’s Services, you acknowledge and agree that:

Communications may be handled by artificial intelligence
Calls, SMS, emails, and chats may be recorded, logged, or stored
AI responses are automated and not human-generated

You are solely responsible for obtaining any legally required consent from your customers, leads, or contacts before using AI-driven communications, including compliance with TCPA, CAN-SPAM, GDPR, CCPA, or similar regulations.

Hojo AI is not responsible for improper or unlawful use of the Services by you or your business.

5. Acceptable Use

You agree not to use the Services to:

Violate any laws or regulations
Transmit spam, fraud, or deceptive messages
Harass, threaten, or abuse individuals
Impersonate any person or entity
Distribute malware or malicious code
Infringe upon intellectual property rights

Hojo AI reserves the right to suspend or terminate access for violations of this section.

6. Third-Party Services & Integrations

Our Services may integrate with third-party platforms (e.g., telephony providers, CRMs, payment processors). Hojo AI is not responsible for:

Downtime or failures caused by third-party services
Changes to third-party pricing, APIs, or terms
Data handling practices of third parties

Use of third-party services is subject to their respective terms and policies.

7. Fees, Billing & Payments

Fees, billing cycles, setup costs, and usage limits are defined in your service agreement or proposal.

All payments are:

Non-refundable unless explicitly stated otherwise
Subject to usage overages where applicable

Failure to pay may result in suspension or termination of Services.

8. Intellectual Property

All content, software, workflows, AI configurations, branding, and materials provided by Hojo AI are the exclusive property of Hojo AI, LLC and may not be copied, resold, or reverse-engineered without written permission.

You retain ownership of your business data and content submitted to the platform, subject to the licenses necessary for us to operate the Services.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

Hojo AI makes no guarantees that:

The Services will be uninterrupted or error-free
AI outputs will be accurate, complete, or suitable for every use case
The Services will increase revenue or profits

You acknowledge that AI-generated outputs may contain errors and should be reviewed before use.

10. Limitation of Liability

To the maximum extent permitted by law, Hojo AI shall not be liable for:

Indirect, incidental, special, or consequential damages
Lost profits, revenue, data, or business opportunities
Claims arising from misuse of AI communications

Hojo AI’s total liability shall not exceed the amount paid by you to Hojo AI in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Hojo AI, LLC and its officers, employees, and partners from any claims, damages, or liabilities arising from:

Your use of the Services
Your violation of laws or regulations
Your failure to obtain proper consent for communications

12. Termination

Hojo AI may suspend or terminate Services:

For violation of these Terms
For non-payment
At its discretion with or without notice

Upon termination, your right to use the Services immediately ceases.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
